tenantd License Terms
tenantd is free, closed-source software. There is no license fee for any feature, on any number of servers. These terms govern your use of it. Optional paid support is offered under a separate support agreement (see pricing and support) and is never required to use the Software.
1. Grant
Licensor grants you a non-exclusive, non-transferable, non-sublicensable, royalty-free license to install and use the Software on any number of servers, for your own internal hosting operations and the hosting of your customers' workloads, for as long as you comply with these terms. No fee is payable for this grant.
2. Restrictions
You shall not:
- (a) redistribute the Software, in source or binary form, to any third party other than your own employees and contractors operating your hosting infrastructure, or re-publish the RPM artifacts outside the official channel;
- (b) sublicense, rent, lease, sell, or transfer the Software, including by re-packaging it inside a managed-service offering whose end customers receive direct administrative access to tenantd configuration files;
- (c) modify, decompile, disassemble, or reverse-engineer the Software, except to the extent (and only to the extent) such activity is expressly permitted by applicable law notwithstanding this limitation;
- (d) remove or alter any proprietary notices in the Software;
- (e) use the Software to evaluate its technology for the purpose of building or contributing to a competing isolation layer.
The Software is free, but it is not open source. The source is not provided, and clauses (a) and (c) are how it stays closed.
3. Cleanroom invariant
The Software does not contain, link to, or derive from the source of any component released under the GNU General Public License (GPL). In particular, it does not derive from CloudLinux Software Inc.'s mysql-governor GPL source tree. This cleanroom invariant is a license condition; any contribution that violates it is rejected from the source tree, and any user who reports a discovered violation in good faith is credited in the next release note.
Optional subpackages may depend on GPL or AGPL projects via standard system package management (Requires:); that does not subject the Software's own source to GPL obligations.
4. Intellectual property
All right, title, and interest in and to the Software, including all intellectual property rights, are and shall remain the exclusive property of Licensor. These terms do not grant you any rights to Licensor's trademarks except for the limited factual identification of the Software in your customer-facing materials.
5. No warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE TENANTD DOCUMENTATION EXPLICITLY DOCUMENTS THE IO-ISOLATION GAP ON A SHARED MYSQLD; YOU ACKNOWLEDGE THAT THE GAP IS BY DESIGN AND NOT A DEFECT.
6. Limitation of liability
IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING FROM OR IN CONNECTION WITH THE SOFTWARE OR ITS USE. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, LICENSOR'S TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100), OR, WHERE A PAID SUPPORT AGREEMENT IS IN EFFECT, THE SUPPORT FEES PAID IN THE TWELVE MONTHS PRECEDING THE EVENT.
7. Termination
These terms terminate automatically on your material breach of §§ 2 or 3, with a 30-day cure period after written notice, or at any time at your discretion. On termination you shall uninstall the Software. Roll-back via tenantctl-migrate --rollback followed by dnf remove tenantd* satisfies the uninstall requirement.
8. Governing law
These terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Wilmington, Delaware.
9. Entire agreement
These terms, together with any separate support agreement you enter into, constitute the entire agreement between the parties with respect to the Software.
